On January 12, 2017, Berger Schatz Managing Partner Leon I. Finkel argued before the Illinois Supreme Court in Springfield, Illinois. At issue before the state’s highest court in the case of In re the Former Marriage of Heroy were two questions: first, whether a party must prove an “inability to pay” in order to be awarded attorney’s fees from the other party — a significant question that could clarify an important inconsistency in Illinois matrimonial law; and second, whether an appellate court has the power to recalculate a trial court’s maintenance finding.
