Managing Partner Leon Finkel, with Partner Peter Sullivan, won a major victory in the Illinois Supreme Court on behalf of our client, Donna Tuke.
In a unanimous decision issued on March 23, 2017, the State’s highest Court ruled in favor of Donna and reversed the appellate court on two issues. It restored (increased) Donna’s maintenance to the amount ordered by the trial court and affirmed the trial court’s award of attorneys’ fees to Donna to defend against her former husband’s attempts to lower her maintenance payments.
The ruling is a victory for parties whose former spouses have a superior ability to finance divorce litigation and makes the playing field more even for financially disadvantaged spouses seeking to protect their rights.
The Supreme Court’s ruling provided welcome relief to Ms. Tuke, who has spent more than ten years defending her maintenance rights with Berger Schatz at her side.
