The Illinois Appellate Court (Fourth Division) reversed a Cook County trial court’s decision terminating the maintenance of a Berger Schatz client. In a unanimous decision, the Appellate Court concluded that the trial court abused its discretion by terminating the former wife’s maintenance without taking into account the full value of her former husband’s property holdings, and by improperly considering the availability of public assistance when assessing her financial needs. In addition, the Appellate Court remanded the case for consideration of whether the former husband should be held in contempt of court for stopping maintenance payments in bad faith.
